1. Introduction and Scope

This Privacy Policy explains how Aegis Luxury Real Estate ("Aegis," "we," "us," or "our"), a California-licensed real estate brokerage (CA DRE# 01328224), collects, uses, discloses, and retains personal information when you use aegishomesre.com, alstonhomes.com, and any other website, application, page, tool, or service operated by Aegis that links to this Privacy Policy (collectively, the "Sites"), and the real estate brokerage, marketing, and related services we provide through or in connection with the Sites (collectively with the Sites, the "Services"). Our Services are intended for U.S. residents only.

By using our Services, you acknowledge that your personal information will be handled as described in this Privacy Policy. Your use of the Services, and any dispute over privacy, is also subject to our Terms of Service.

This Privacy Policy does not apply to the practices of third parties that we do not own or control, including multiple listing services ("MLSs"), lenders, title and escrow companies, inspectors, other brokerages and their agents, and third-party websites or applications you may access through the Services. We encourage you to review the privacy policies of any third party with whom you interact.

This Privacy Policy also does not cover disclosures or rights provided under the federal Fair Credit Reporting Act (FCRA), the federal Gramm-Leach-Bliley Act (GLBA), or state-specific financial privacy laws, where those laws apply instead.

2. What Is Personal Information?

"Personal Information" means any information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, to you or your household. Personal Information does not include information that has been de-identified or aggregated such that it can no longer reasonably be linked to you, or information that is publicly available from government records or lawfully made available to the general public.

3. Notice at Collection

If you are a resident of California or another state with a comprehensive privacy law, this section serves as our Notice at Collection. Depending on how you interact with the Services, we collect the following categories of Personal Information for the business and commercial purposes described in this Privacy Policy:

Identifiers: Name, alias, postal address, email address, telephone number, account credentials, IP address, device and cookie identifiers, and other similar identifiers.
Customer Records: Contact details and, for brokerage clients, information customary to a real estate transaction, such as financial or payment information, loan pre-approval documentation, and property disclosure information.
Commercial Information: Property search history, properties you view, save, or inquire about, tour requests, transaction history, and records of services considered or obtained.
Internet or Other Electronic Network Activity: Browsing history on our Sites, search history, pages viewed, links clicked, referring URLs, and interactions with our content, forms, listings, market reports, and advertisements.
Geolocation Data: Approximate location derived from your IP address and, only with your permission via your device or browser settings, precise geolocation to show homes and market information near you.
Audio, Electronic, or Visual Information: Call recordings (where permitted by law and disclosed to you), voicemails, text messages, chat transcripts, and photographs or documents you provide.
Professional or Employment-Related Information: Employment and income information you provide in connection with a purchase, sale, or financing pre-qualification.
Inferences: Preferences and interests drawn from the information above, such as the neighborhoods, cities, price ranges, and property characteristics that appear to interest you, used to personalize your experience and our communications.
Sensitive Personal Information: In limited circumstances, account log-in credentials, financial account information provided in connection with a transaction, and precise geolocation (if enabled by you). We collect and use Sensitive Personal Information only to provide the Services, facilitate transactions, verify identity, and maintain security, and we do not use it to infer characteristics about you.

Purposes: We use this information to provide and improve the Services, respond to your requests, facilitate real estate transactions, personalize content and communications, market our Services, and maintain security, as described in Section 5.

Retention: We retain Personal Information only as long as reasonably necessary for the purposes described in this Privacy Policy, including to comply with real estate record-keeping requirements under California law and other legal obligations, as described in Section 8.

Sale/Sharing: We do not sell your Personal Information for monetary consideration. Our use of advertising and analytics technologies may constitute "sharing" or a "sale" under certain state privacy laws; see Sections 6 and 10 for details and your opt-out choices.

4. Information We Collect

A. Information You Provide to Us

Inquiries and Requests: When you request a home tour, ask about a listing, request a market analysis or home valuation, sign up for listing alerts or market reports, or otherwise contact us, we collect your name, email address, phone number, and the content of your message, along with your date and time preferences where applicable.
Account and Alert Registration: If you create an account or subscribe to alerts, we collect your name, email address, and any preferences you save, such as saved searches, favorite properties, and communication preferences. Certain account information may be required as a condition of our license agreements with MLSs in order to provide you access to full MLS listing content.
Client Transaction Information: If you engage Aegis to represent you in buying or selling a home, we collect information customary to a real estate transaction, which may include your name, address, phone number, email address, financial and payment information, buyer loan pre-approval documentation, and seller property disclosure information. Once you sign a listing agreement or buyer representation agreement with us, your relationship with Aegis is also governed by that agreement.
Communications: When you communicate with us by email, phone, text message, chat, or web form, we collect the contents of those communications. We may record telephone calls for training, quality assurance, and record-keeping purposes where permitted by law and with any legally required notice or consent.
Calls and Text Messages: If you consent to receive calls or SMS text messages from Aegis, that consent is collected solely so that we may call or text you in connection with the Services or, where you have agreed, for marketing purposes. Message and data rates may apply. You may opt out of text messages at any time by replying STOP. We do not sell your phone number to third parties, and we do not share text messaging opt-in data or consent with third parties for their own marketing purposes.
Reviews, Surveys, and Feedback: If you submit a review, testimonial, survey response, or other feedback, we collect the content you provide together with your contact information.

B. Information We Collect Automatically

Like most websites, we and our service providers automatically collect certain information when you visit or interact with the Sites, using cookies, pixels, web beacons, scripts, log files, and similar technologies. This includes your IP address, browser type and settings, device type and operating system, mobile device identifiers, Internet service provider, date and time stamps, referring and exit URLs, and information about your activity on the Sites, such as the pages and property listings you view, the searches you run, the filters you apply, the links you click, and the amount of time you spend on different parts of the Sites.

We use this information to operate, secure, and improve the Sites; to remember your preferences; to analyze trends and measure the performance of our content and marketing; to diagnose technical problems; to detect and prevent fraud and abuse; and to personalize the listings, market information, and communications we show or send you. Information collected automatically may be combined with other Personal Information we hold about you.

C. Information from Other Sources

MLS and Public Records: We receive property listing data from MLSs and obtain information from public records, such as county assessor and recorder data. Home sales and purchases are frequently a matter of public record; your name, property address, sale price, and property tax information may be publicly available regardless of which brokerage assists in a transaction.
Service Providers and Business Partners: We may receive information from analytics providers, advertising partners, marketing and search-data platforms, communication providers, and other vendors that assist us in operating the Services, and we may combine it with information we already hold.
Third-Party Sign-In and Platforms: If you interact with us through a third-party platform (for example, a social network or a home-search or client-communication tool), we may receive information from that platform consistent with its privacy policy and your settings on that platform.

5. How We Use Personal Information

We use the Personal Information we collect for the following business and commercial purposes:

To operate the Sites and provide the Services, including displaying property listings, market reports, school and community information, and other real estate content;
To respond to your inquiries, tour requests, valuation requests, and other communications, and to provide customer support;
To represent you in the purchase or sale of real property and to perform our obligations under any listing agreement, buyer representation agreement, or other contract with you;
To create and administer your account, saved searches, favorites, and alerts;
To send you listing alerts, market updates, newsletters, and marketing communications in accordance with your preferences and applicable law, including the CAN-SPAM Act and the Telephone Consumer Protection Act (TCPA);
To personalize your experience, including tailoring the listings, content, and communications we present based on your activity and inferred preferences;
To conduct analytics and research to understand how the Services are used and to improve, upgrade, and develop our Sites, content, and Services;
To market and advertise our Services, including measuring the performance of our advertising;
To detect, investigate, and prevent security incidents, fraud, and other malicious, deceptive, or illegal activity, and to protect the rights, property, and safety of Aegis, our clients, and others;
To identify and repair errors and to verify or maintain the quality and safety of the Services;
To comply with our legal and regulatory obligations, including real estate license, record-keeping, and disclosure requirements under California law;
To enforce our agreements and defend legal claims; and
For any other purpose disclosed to you at the time of collection or with your consent.

6. How We Disclose Personal Information

We do not sell your Personal Information for monetary consideration. We disclose Personal Information in the following circumstances:

Transaction Parties: If you buy or sell a home with us, we share your information as customary and necessary to complete the transaction, including with MLSs; the other party's brokerage and agent; lenders and mortgage brokers; title, escrow, and closing companies; inspectors, appraisers, and contractors; transaction-management, document-preparation, and electronic-signature providers; and attorneys. If you are a seller, we share your listing information with MLSs, which in turn syndicate listings to other brokerages and listing websites; as a result, your listing may appear on multiple websites, and we cannot opt out of MLS-required listing distribution. By law, we may also be required to disclose certain information about your property to potential buyers.
Service Providers: We share Personal Information with vendors that perform services on our behalf, such as website hosting and infrastructure, data storage, analytics, email and text-message delivery, customer-relationship management, marketing, scheduling, and security providers. We contractually restrict service providers from using Personal Information for any purpose other than performing services for us.
Advertising and Analytics Partners: We may allow analytics and advertising companies to collect information on our Sites through cookies and similar technologies, and we may share identifiers and activity data with them, to measure our marketing and to serve you more relevant advertising. This may constitute "sharing" or a "sale" under certain state privacy laws; see Section 10 for your opt-out rights.
Referrals You Request: If you ask us to connect you with another professional (for example, a lender, contractor, stager, photographer, or an agent in another market), we will share your contact information and relevant details with that professional to respond to your request.
Legal Compliance and Protection: We may disclose Personal Information to comply with applicable law, regulation, legal process, or governmental request (including subpoenas and court orders); to enforce our agreements and this Privacy Policy; to detect, prevent, or address fraud, security, or technical issues; and to protect the rights, property, or safety of Aegis, our clients, or the public.
Business Transfers: If Aegis is involved in a merger, acquisition, financing, reorganization, bankruptcy, or sale of some or all of its assets, Personal Information may be disclosed or transferred as part of that transaction, subject to applicable law.
With Your Consent or at Your Direction: We may disclose Personal Information to other third parties with your consent or at your direction, including if you post content to public areas of our Sites or social media pages, which will be visible to others.

We may also use and disclose de-identified or aggregated information, which is not Personal Information, for any lawful purpose, including research, analytics, and market reporting. Where we maintain de-identified information, we will not attempt to re-identify it except as permitted by law to test the effectiveness of de-identification.

7. Cookies, Analytics, and Interest-Based Advertising

We use cookies and similar technologies on the Sites. These include essential cookies necessary for the Sites to function; functionality cookies that remember your preferences; and analytics and advertising cookies that help us understand how visitors use the Sites and measure and improve our marketing.

Analytics: We use third-party analytics services, which may include Google Analytics, to help us understand traffic and usage on a de-identified or aggregated basis. You can learn how Google uses data at policies.google.com/privacy/partners and opt out of Google Analytics at tools.google.com/dlpage/gaoptout.
Interest-Based Advertising: We may work with advertising networks and platforms that collect information about your activity on our Sites and other websites over time to serve you ads that are more relevant to your interests. You can learn about and opt out of many interest-based advertising practices at optout.aboutads.info and optout.networkadvertising.org. Opt-outs are typically cookie- and browser-specific, so you may need to renew them if you clear cookies or use a different browser or device.
Browser Controls: Most browsers allow you to block or delete cookies through your browser settings. If you disable cookies, you can still browse the Sites, but some features may not function properly.
Global Privacy Control: If our Sites detect that your browser or device is transmitting a recognized opt-out preference signal, such as the Global Privacy Control (GPC), we will treat it as a request to opt out of the "sale" or "sharing" of Personal Information associated with that browser or device, as required by applicable state law. The signal is browser- and device-specific.
Do Not Track: Apart from recognized opt-out preference signals such as GPC as described above, our Sites do not respond to "Do Not Track" browser signals, for which no uniform standard has been adopted. This disclosure is provided in accordance with the California Online Privacy Protection Act (CalOPPA).

8. Data Retention

We retain Personal Information for as long as reasonably necessary to fulfill the purposes for which it was collected, including to provide the Services, maintain your account and alerts, comply with legal obligations (including California Business and Professions Code record-retention requirements applicable to real estate brokers, which require brokers to retain transaction records for at least three years), resolve disputes, establish and defend legal claims, and enforce our agreements. When retention is no longer necessary, we will delete or de-identify the information. Personal Information may persist in secure backup archives for a limited period until those backups are cycled or deleted.

9. Security

We maintain administrative, technical, and physical safeguards designed to protect Personal Information against unauthorized access, use, alteration, and disclosure. However, no method of transmission over the Internet or method of electronic storage is completely secure, and we cannot guarantee absolute security. You are responsible for maintaining the confidentiality of any account credentials and for limiting access to your devices. Please notify us immediately if you believe your account has been compromised.

10. California Privacy Rights (CCPA/CPRA)

This section supplements the rest of this Privacy Policy and applies only to California residents ("consumers"). It is provided pursuant to the California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act of 2020 (collectively, the "CCPA").

Categories Collected, Disclosed, Sold, or Shared

In the preceding twelve (12) months, we have collected the categories of Personal Information described in Section 3 (Notice at Collection) from the sources described in Section 4, and we have disclosed each of those categories for business purposes to the categories of recipients described in Section 6.

We do not disclose Personal Information to third parties in exchange for monetary consideration. However, our use of advertising cookies and related technologies may constitute a "sale" or "sharing" of the following categories under the CCPA: identifiers, internet or other electronic network activity information, and inferences. The categories of third parties involved are advertising networks, analytics providers, and social networks. We do not sell or share the Personal Information of consumers we know to be under sixteen (16) years of age. We do not use or disclose Sensitive Personal Information for purposes that would trigger the right to limit its use under the CCPA.

Your CCPA Rights

Right to Know/Access: You may request that we disclose the categories and specific pieces of Personal Information we have collected about you, the categories of sources, the business or commercial purposes for collection, and the categories of third parties to whom we disclose it.
Right to Correct: You may request that we correct inaccurate Personal Information, taking into account the nature of the information and the purposes of processing.
Right to Delete: You may request that we delete Personal Information we have collected from you, subject to exceptions permitted by law (for example, to complete a transaction, comply with legal record-keeping obligations, detect security incidents, or exercise or defend legal claims).
Right to Opt Out of Sale/Sharing: You may direct us not to "sell" or "share" your Personal Information. You may exercise this right by contacting us as described in Section 15, by adjusting cookie preferences on our Sites where available, or by using a recognized opt-out preference signal such as the Global Privacy Control.
Right to Non-Discrimination: We will not discriminate against you in price or service level for exercising any of your CCPA rights.

Exercising Your Rights

To exercise your rights, contact us using the methods in Section 15. We will need to verify your identity before responding, which may include matching information you provide against information in our records; where we cannot verify your identity, we may be required to deny the request and will explain why. You may authorize an agent to submit a request on your behalf; we require the agent to provide written, signed authorization from you (or a valid power of attorney), and we may also require you to verify your identity directly with us. We will respond to verifiable requests within the timeframes required by law (generally 45 days, extendable once by an additional 45 days with notice). If we deny your request in whole or in part, you may appeal by contacting us and referencing your original request.

"Shine the Light"

California Civil Code Section 1798.83 permits California residents with an established business relationship with us to request, once per calendar year, information about our disclosure of certain categories of personal information to third parties for those third parties' own direct marketing purposes. We do not share personal information with third parties for their own direct marketing purposes. To submit an inquiry, contact us as described in Section 15 with "California Shine the Light Request" in the subject line.

Removal of Minors' Posted Content

California residents under 18 who are registered users of the Services may request removal of content or information they have publicly posted by contacting us as described in Section 15 with the email address associated with their account. Removal may not be complete or comprehensive in all circumstances as permitted by law.

11. Additional U.S. State Privacy Rights

If you reside in a state with a comprehensive consumer privacy law (including, as of the date of this Policy, Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Montana, Florida, Delaware, Iowa, Nebraska, New Hampshire, New Jersey, Kentucky, Maryland, Minnesota, Rhode Island, Tennessee, and Indiana, as their laws take effect), you may have some or all of the following rights, subject to the definitions, conditions, and exceptions of your state's law:

The right to confirm whether we are processing your Personal Information and to access it;
The right to correct inaccuracies in your Personal Information;
The right to delete Personal Information provided by or obtained about you;
The right to obtain a copy of Personal Information you provided to us in a portable and, where technically feasible, readily usable format;
The right to opt out of (i) targeted advertising, (ii) the sale of Personal Information, and (iii) profiling in furtherance of decisions that produce legal or similarly significant effects (we do not engage in such profiling); and
In certain states (including Delaware, Oregon, and Minnesota), the right to request a list of the third parties to whom we have disclosed Personal Information.

To exercise these rights, contact us as described in Section 15. We will verify your identity before acting on a request and will respond within the time required by your state's law. If we decline to act on your request, you may appeal our decision by contacting us and referencing your original request; if your appeal is denied, you may contact your state Attorney General. Residents of states that recognize universal opt-out mechanisms may opt out of targeted advertising and any "sale" of Personal Information by enabling the Global Privacy Control in their browser, as described in Section 7.

Nevada residents: Chapter 603A of the Nevada Revised Statutes permits Nevada residents to opt out of the sale of certain covered information. We do not sell covered information as defined by that law; if that changes, Nevada residents may submit an opt-out request using the contact information in Section 15.

12. Children's Privacy

Our Services are directed to adults and are not directed to children under 13. We do not knowingly collect Personal Information from children under 13, consistent with the Children's Online Privacy Protection Act (COPPA). We also do not sell or share the Personal Information of anyone we know to be under 16. If you believe a child under 13 has provided us Personal Information, please contact us as described in Section 15 with the subject line "COPPA Child Information Request," and we will promptly delete such information as required by law.

13. Third-Party Websites and Services

The Services may contain links to websites, tools, and services operated by third parties, including MLS consumer portals, lender and title-company sites, school-information providers, mapping services, and social media platforms. Links open in a new window for your convenience. We do not control these third parties and are not responsible for their content or privacy practices. Your use of third-party websites and services is at your own risk and subject to their privacy policies.

14. Changes to This Privacy Policy

We review this Privacy Policy at least annually and may update it from time to time to reflect changes in our practices or applicable law. When we make changes, we will update the "Last Updated" date at the top of this page. If we make material changes, we will provide notice as required by applicable law, which may include a prominent notice on our Sites or an email to registered users. Your continued use of the Services after the effective date of an updated Privacy Policy constitutes your acknowledgment of the updated Policy to the extent permitted by law.
